How exactly are you attempting to download it now?

That tool will support an in place upgrade or....
You can download the ISO (create media) and use that to perform the upgrade at your convenience

I have to say, the in place upgrade (which I wouldn't recommend, nor would I do on my main gaming PC), work flawlessly on my tablet. Upgraded from a modified Windows 7 sp1, and all my settings and drivers worked out of the box. That wasn't the case with the earlier preview releases.
