I have a HP HPE 1075UK with win 7pro, it started to download today win 10 pro and it tried to install but it says failed to install the Toshiba on win 8.1 has the same error. Has this been caused by Microsoft downloading automatically and then trying to install on the wrong date. I did not ask the machine to download and try and install?????? on 28th will hopefully on 29th these machines will install however will this be on west coast usa time and euro time for euro machines.

Yep.
I suspect that at some point tomorrow or shortly thereafter it'll succeed as soon as the second part of that download comes along. The initial part seems to be missing some key bits which I suspect are still to come.
Mine has failed twice now. I'm not starting to worry...... yet!
